“To authorize the prosecution of a president for his official acts would open up Pandora’s box from which this nation may never recover,” Sauer said.

If the judges rule against absolute presidential immunity, Sauer said, “It would authorize, for example, the indictment of President Biden in the Western District of Texas after he leaves office for mismanaging the border, allegedly.”

Taking the hypotheticals even farther, Sauer looked back to history, and raised the possibility of past presidents being charged for some of their most controversial official actions.

“Could George W. Bush be prosecuted for obstruction of an official proceeding for allegedly giving false information to Congress, to induce the nation to go to war in Iraq under false pretenses? … Could President Obama be potentially charged for murder for allegedly authorizing drone strikes targeting US citizens located abroad?”

Rather more relevant than the UK examples.

The question then is whether Trump’s actions to try to change to out come of the election were official acts or acts conducted in subterfuge. Acts that were not for a president to conduct as they undermined the constitution.

The court will hear arguments in less than two weeks in a historic case that has the potential to disrupt the 2024 presidential election.

In a filing filled with vivid descriptions of the Jan. 6, 2021, violence at the Capitol, the lawyers include extensive details of Trump’s actions leading up to Jan. 6, including his tweet on Dec. 19, 2020, in which he informed his followers of the planned protest on the day Congress would count the electoral votes and wrote, “Be there, will be wild.”

The justices are hearing arguments Feb. 8.

It’s pretty remote that Trump will be found ineligible to run for office, but you never know. . . .

I would imagine that America would have a shed load of trouble on its hands if Trump is deemed ineligible to stand as the next potus Butterscotch…

Is Trump facing trial in Texas as well?
I know there is a lot of legal cases against Trump going on about all the bad stuff he’s done (or … errr… “alleged” to have done, should I say!) but I had not heard of any in Texas - I would have thought a State which has a Republican majority and Supreme Court controlled by Republicans would be an unlikely state to take action against Trump :woman_shrugging:

I hope justice is served and Trump gets what he deserves - but I won’t hold my breath.

Apparently the immigration at the border with Mexico has got well out of hand, and the Texas authorities are taking things into their own hands, supported by 25 other states. There was a deadline set by sleepy Joe that he would send the national guard to prevent Texas guards from blocking the immigrants. Bidens policy has been to tear down the wall that Trump erected and remove the border patrols allowing immigrants to flood in bringing drugs and crime into the villages and towns of border states. Reports may vary…

Oh, that - yes, I know all about that - the BBC have been reporting on that - I was reading a BBC article about it yesterday. maybe you just don’t read their website, so you don’t see All their news reports.

This thread is about a Trump court case, so I presumed your post was about another Trump court case I hadn’t heard about - I should have guessed it would be more random than that - I forgot about the tendency to go off-piste, even on these serious threads! :wink:

You know me so well boot…I must agree with you that I haven’t been on a BBC website (except for the weather, Paul Hudson is brilliant) for ages. Neither do I take a paper (except the Doncaster free press which is passed on to me by a neighbour, mainly for the sudoku) All my news comes either off the forum, occasionally from X (formerly twitter) or mainly from my daughter when she visits. She’s a bit of an urban warrior, I don’t know where she gets it from… :thinking:
How serious can a thread be on an over fifties forum? And most of the time the thread has died a death anyway so I just enhance it a bit. I’m not just remembered for my rambling in the countryside boot, I do tend to let my mind go where it will…If we were stood at a bar with a drink in our hands, wouldn’t the conversation ebb and flow as we adapt our own interpretation on even serious things happening in the world? A federal judge has postponed the election subversion trial of former US president Donald Trump while his appeal plays out in court.

The trial was set to begin on 4 March, but will now be delayed indefinitely, Judge Tanya Chutkan said on Friday.

The case is over Mr Trump’s alleged efforts to overturn the 2020 election results.

His lawyers have argued that he should not face criminal charges because he was a sitting president at the time.

The Republican frontrunner for president in November’s election was charged last year over his alleged efforts to overturn his 2020 loss to Democrat Joe Biden.

The case could be delayed for several months as the appeal process plays out.

Its dismal but it looks like, one by one, Trump will duck these court cases and be free to stand and win the coming election.

There’s a good reason why Trump will win the next election. Firstly because sleepy Joe is not up to the job, and secondly, because Trump will deliver the kind of America that most Americans want.

Are you sure about that? One he failed to deliver on just about everything last time round. Two, he did not win the majority vote in 2020 so not “most Americans”. Three Biden has delivered jobs, growth and stability - and that typically is what most people want.

It is a setback for Mr Trump who has for years cited presidential immunity while battling multiple cases.

The former president is expected to appeal against the ruling, meaning the case could ultimately go to the Supreme Court where conservatives hold a 6-3 majority.

US Special Counsel Jack Smith has charged Mr Trump, 77, with conspiring to overturn Joe Biden’s victory in the 2020 election and committing fraud to stay in office.

The trial in that case was initially scheduled for 4 March, but was postponed pending a ruling on the immunity claim.

It could be delayed for weeks, if not months, if the case ends up before the Supreme Court.

So, a moral victory.

Odd how there hasn’t been a problem before.
