Fresh DNA evidence has emerged linking another suspect to the crime, so why has this miscarriage of justice taken so long to overturn?

I listened to an interview with Andrew Malkinson this morning on the Today programme and was appalled at the way in which he was treated. Apparently the authorities tried to persuade him to go to group therapy sessions whilst he was in prison which would have enabled him to be released earlier. He refused because being innocent he would have been expected to describe in detail a crime which he did not commit and also have to listen to other inmates describing their crimes. He has been treated badly by both the police and judiciary in my opinion.

Does seem strange its taken so long to overturn this incorrect verdict.
An example why capital punishment was abolished.

I read he was kept in longer because he wouldn’t admit to the crime …
And he was convicted on likeness to the ID plus him being in the area at the time , when you look at the ID picture its nothing like him whats so ever at that tme …
Its a crime he as been in and lost so many years of his life , …
I hope he will be compensated well .
And what of the Police will they be brought to account …

The injustice against Andrew Malkinson went from bad to worse.
It was appalling that the prosecution did not disclose several pieces of material evidence to the Court which may have affected the verdict during Mr Malkinson’s trial.

Then, even worse, when DNA evidence was found on the victim’s clothes in 2009 which definitely did not belong to Andrew Malkinson and as it was found inside the victim’s underwear, it must have been obvious that it was likely they may have accused and convicted the wrong person, yet the Criminal Cases Review Commission decided not to review Mr Malkinson’s conviction.
In the meantime, Mr Malkinson was denied parole because he maintained his innocence - if they had re-tried his case in the light of the new evidence when they first discovered the DNA, he may have been released at least a decade earlier - and the police may have been able to apprehend the real rapist a decade sooner.

Nothing will give Mr Malkinson all those years in prison back and they have denied him the chance to build up a pension and prepare for his retirement, so I hope he is granted a hefty amount of compensation to enable him to live very comfortably in future.

I hope there is some repercussions for all the people in the justice system who were responsible for letting Mr Malkinson down so badly - and letting the rape survivor down too - but I bet some of them may have retired by now or been promoted on to somewhere else. :angry:

Well i hope the person who accused him has her day in court.How sad he has spent 17 years in prison for something he didn`t do.
He wont get a single minute of that back.

He was indeed and it was all too convenient to keep him behind bars and bury the files in their deep-litter system rather then investigate deeper🤷‍♂️
